III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations <br />made during the inspection. Comments also describe any enforcement actions taken during <br />the inspection and the facts or evidence supporting the enforcement action. <br />This was a complete inspection conducted by Janet Binns of CDMG. Sandra White and Jerry Nettleton, of BTU- <br />Empire/RAG- Empire Corp. accompanied the inspection and provided access to the records. The mine is in <br />Temporary Cessation. No active mining activity is occurring on the mine site. Mine site is dry and temperatures <br />were mild, approximately high 40's. <br />Records: Records were checked at the mine office. Records list accompanies this report. <br />ins and Markers: Mine [D sign posted at entrance from State Highway 13 at both the entrance to the Williams <br />fork Strip Pit and to the No. 5 and No. SA portal areas. <br />Roads: Roads are in good condition through out mine site. Access road to 9-P2 and 9-P3 ponds has been <br />regraded to eliminate badger holes. Haul Road A in the N '/z Section 32 remains unreclaimed. This haul road is <br />in the permit yet seldom used. <br />Hydrologic Balance: Snow pack has mostly melted off.
