III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />every week. Pond C was not dischazging at the time of the inspection. The water level in <br />Pond C was right up to the primary dischazge tube level. The flow path for the Pond C <br />dischazge that brings the water to the Deer Trail Ditch was examined and there was no <br />evidence of any coal fines or erosional problems in the ditches and culverts. The operator <br />has seeded and mulched that portion of the embanlartent of Pond C that was used for <br />equipment access in the cleaning out of the pond. <br />There was some water, well below the level of the primary dischazge tube, in Pond B. <br />There was some snowmelt in Pond D, also well below the primary dischazge stage. Pond <br />J was dry, except for a little snow on the pond inslope. Pond K was neazly dry. All pond <br />inslopes and outslopes appeared to be stable, as did the embanlanents. Gated dischazge <br />valves were closed. <br />Silt fence and straw bales for sediment control were in place at the various locations <br />aoound the mine site. The operator was in the process of replacing some of the straw <br />bales in the areas aoound Pond C and Pond D. <br />All of the culverts and ditches around the mine site and loadout azea were functional and <br />had sufficient capacity, although a few of the culverts and ditches at the higher elevations <br />were snow-covered. The operator performed maintenance work on the three culverts that <br />were noted in last month's inspection report. <br />The seep azea on the west side of the water tank bench was snow-covered. The seep <br />along the road that leads from the portal bench to the watertank bench was not flowing. <br />There were still two small seep azeas in the cut slope on the east end of the train loadout <br />tracks, even though the Fue Mountain canal above the seep azeas has not held water for <br />several months. The seep water on the west end of the train loadout tracks was not <br />flowing. <br />To»soil <br />The north facing slope of the main topsoil stockpile at the mine site was snow-covered. <br />The south facing slope was free of snow, except for the diversion ditch and the collection <br />ditch with straw bales. The vegetation on the main topsoil stockpile was nibbled short <br />due to wildlife grazing, but no erosional problems were observed. The topsoil signs were <br />up. <br />2 <br />
