III. COMMENTS -COMPLIANCE <br />Below aze comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This was a complete inspection conducted by Joe Dudash of the Colorado DMG. Bill <br />Bear represented the operator. Snow covered portions of the mine site. The ground was <br />frozen in the morning but started to thaw out in the afternoon. <br />S1QI1S and Markers <br />Mine 1D signs were up at the proper [ocations. The information on the signs was correct. <br />Surface disturbance mazkers were up around the mine site. Topsoil stockpile signs were <br />also present at the required locations. <br />Roads <br />The paved haul road up to the portal bench, with its associated guazdrail, was in very <br />good condition. The haul road leading to the gob pile was also in very good condition. <br />The road berm attd ditch were functional. The access road leading from the portal bench <br />to the water tank bench was in good condition, as were the associated outside berm and <br />inside ditch. <br />Facilities <br />There were no trains being loaded at the unit train loadout at the time of the inspection. A <br />few coal haul trucks were being loaded with specialty coal from the portal bench coal <br />stockpile, however. The coal stockpile on the portal bench was small in size. The pile was <br />away from the portal bench outside berm. The coal stockpile adjacent to the highway was <br />moderate in size. The coal stockpile outside berm was functional. No problems with <br />fugitive dust were noted at these two coal stockpile locations or anywhere along the <br />conveyor belt line and train loadout. <br />No problems were observed at any of the facilities. There were no leaks at the fuel barn: <br />The material storage sites were all in order. The cap and powder houses were locked. <br />Hydrolo¢y <br />Bowie has been pumping mine water to a series of collection ditches that bring the mine <br />water to Pond C. The operator stated that the pumping has been fora 24 hour period once <br />
