III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection, The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />Based on close inspection of snow-free areas of the lower "A" Pit, to the north and east of the oil well <br />bench, some minor regrading will be necessary on areas topsoiled last fall, to re-direct drainage from <br />various sub-basins so that a larger component of the runoff from slopes and upland swales is directed <br />into the constructed channel (006-NE2). Subtle topographic features in this area have caused flow from <br />certain areas both to the east and to the west of the 006-NE2 channel, to bypass the channel, resulting <br />in rills and gullies in certain locations along the steep slope down to the 006 Gulch channel. Minor <br />grading will be necessary to redirect upland flow into the 006-NE2 channel. Areas of gully erosion <br />(including a significant gully immediately east of the oil well pad) will need to be delineated on the 2005 <br />Rill and Gully Map, and appropriate repairs will need to be implemented when the locations are safely <br />accessible. <br />Rill erosion was also noted in some locations along scraper routes within the same general area of the <br />lower "A" Pit, where drill seeding had been oriented parallel to the scraper route. Maintenance <br />treatments are warranted. Re-drilling on the contour, or other. soil scaritication/ seeding. treatments and <br />possibly installation of closely spaced water bars may be appropriate in these locations. , .. <br />Topsoil and Revegetation <br />Topsoiling and seeding operations were largely completed in the lower "A" and "B" pit reclamation areas <br />in fall 2004. An area of less than 20 acres was not topsoiled and seeded, due to ground and weather <br />conditions, and will be completed as soon as ground conditions allow this spring. Also, as discussed in <br />the November 2004 inspection report, topsoil replacement and planting was .not completed in the Swale <br />location that drains off the east side of the ridgeline pit graded area, in the Pond 015 watershed. Timing <br />associated with approval of PR-4 and associated topsoil salvage did not allow for completion of soil <br />replacement and revegetation in this area. Topsoiling, seeding, shrub/aspen planting, and fencing will <br />occur in this location this spring. <br />The operator has indicated that required soil/spoil sampling was completed last fall and will be submitted <br />with the annual reclamation report by the end of March. <br />8 <br />
