III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />This was a complete inspection conducted by Joe Dudash of the Colorado DMG. Jim Kiger <br />represented the operator. <br />Sims and Mazkers <br />The operator is in the process of ordering new-mine ID signs. The signs that are now in place <br />have the correct information. Permit boundary,mazkers aze up azound the loadout azea perimeter <br />Topsoil stockpile signs were up on the east and west stockpiles. <br />Roads <br />The paved entrance road was in excellent condition. The guazdrail was intact. The east access <br />road was in good condition as well. The east gate was open. The access road along the railroad <br />tracks was passable. <br />Topsoil <br />The vegetative cover on the east topsoil stockpile was spazse. On the south-facing side of the <br />west stockpile, the vegetative cover was almost gone. However, there were no erosional <br />problems at the east and west topsoil stockpiles. <br />Hvdrolo¢y <br />The east pond had a little water in it. The pond's gated valve was closed. The pond embanlanent <br />was stable and well vegetated. Pond inslopes were also stable. <br />The west dugout pond was dry. The spillway and silt fence were functional. The riprapped <br />spillway downdrain was also functional. <br />Culverts and ditches at the loadout were functional. However, the culvert just below the entrance <br />to the graveled pazking lot, designated CMP #1, could use a little cleaning at the outlet. Also, the <br />middle culvert under the raikoad tracks needs cleaning at the inlet. <br />The straw bales and silt fence on the east side of the raikoad SAE need some repair. The <br />operator stated that Union Pacific personnel ran over the structures with a truck. The other straw <br />bales and silt fence were functional. <br />
