IV. ENFORCEMENT ACTIONS <br />The following identifies enforcement actions taken during this inspection, the required abatement and <br />date of abatement for the violation, previous violations still requiring abatement and the termination of <br />violations cited during previous inspections. <br />SCC has not completed all of the abatement steps (topsoil redistribution and seeding) for CO- <br />2003-012 and this cessation order is still pending. The abatement time for CO-2003-012 is on or <br />before January 19, 2004. As stated above an abatement deadline extension request is pending <br />review by the DMG. <br />On December 18, 2003 an Assessment Conference was held at the DMG office between SCC <br />representative Roy Kazo and DMG representatives Jim McArdle, Sandra Brown and Mike <br />Boulay. As a result of the Assessment Conference and based on the testimony presented by <br />DMG staff and the operator, two components of the proposed civil penalty were modified. <br />Although specific components of the civil penalty have been modified the amount of the penalty <br />remains the same. A Settlement Agreement has been prepared and will be sent to SCC. <br />No enforcement actions were taken as a result of this inspection. <br />NOTE: Attach appropriate VIOLATIONS or CESSATION ORDER CODING FORMS <br />Revised 2/97 <br />
