III. COMMENTS -COMPLIANCE <br />_ Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This was a partial inspection of the Yoast Mine conducted on December 16, 2003 by Mike <br />Boulay of the DMG. Roy Kazo of Seneca Coal Company (SCC) was present during the entire <br />inspection. Weather conditions were sunny and cold. Ground conditions at the mine site were <br />wet and mostly snow covered. The dragline was operating above the Wolf Creek coal seam in <br />the Yoast South azea. Coal was being hauled from the mine at the time of the inspection. <br />Roads <br />Only portions of the site were accessible due to snow packed road conditions. Road drainage run <br />outs, road berms and ditches were all snow covered. Haul Roads A and B and the access into the <br />current active pit azea had all been bladed and were accessible and well maintained. <br />Backfill & Gradine, Tonsoil, and Reveeetation <br />Cessation Order CO-2003-012 was issued on October 22, 2003 for failure to complete <br />reclamation required by the approved plan contained in the permit application package; and <br />failure to complete backfill and grading, topsoil redistribution, and seeding for all azeas of the <br />Yoast Mine in accordance with the backfill and grading plan and schedule depicted on Exhibit <br />19-1A (Abatement Steps 1 and 2 of NOV CV-2003-007). Backfilling and grading, topsoil <br />redistribution, and seeding has been completed in the North Pit. The remaining location for <br />which the violation was written is the azea designated for backfill and grading in 2001-2002 as <br />shown on Exhibit 19-1A. This area was assessed during this inspection to determine progress <br />made in completing the abatement steps required for termination of the cessation order. <br />The abatement deadline for CO-2003-012 is January 19, 2004. Backfill and grading work has <br />been completed at this location since the issuance of the cessation order. Topsoil redistribution, <br />and seeding remains to be completed at the 2001-2002 azea. On December 11, 2003, the DMG <br />received an abatement deadline extension request for CO-2003-012 for the topsoiling and <br />seeding activities. The abatement deadline extension request is currently being reviewed. <br />
