III. COMMENTS -COMPLIANCE <br />Below aze comments on the inspection. The comments include discussion of observations made during the inspection. Comments <br />also describe any enforcement acfions taken during the inspection and the facts or evidence supporting the enforcement action. <br />Jerry Nettleton of Twentymile Coal Company (Twentymile) accompanied Byron Walker (Walker) of the <br />Colorado Division of Minerals and Geology (Division) during this inspection, except for checking of records. <br />Sandra White of Twentymile accompanied Walker during the checking of on-site records. Photographs <br />included in this report aze on file in digitized form at the Division, and will be provided to Twentymile upon <br />request. No one accompanied Walker on water quality measurements around, but off, the pemtit azea, and the <br />records check at the Routt County Court House. An advance copy of this report was provided to the operator <br />by a-mail. A courtesy copy of the report was provided to Jeff Coombe, Colorado Department of Public Health <br />and Environment (CDPHE), by a-mail. <br />AVAILABLITY OF RECORDS <br />Public review copies of the Technical Revision Applications 45, 46, and 47 were found on file at the Routt <br />County Court House. All required records were found on file at the mine site. <br />HYDROLOGIC BALANCE <br />There was no dischazge from (Colorado Department of Health and Environment [CDPHE] Permit CO- <br />0027154) Ponds C (004A), E (006A), F(007A), G (OOSA), and T (002A). There was an estimated 0.04 cubic <br />feet per second dischazges at Pond D (OOSA)(0.05 foot on the 12-inch flume gage). The operator reported no <br />discharge from the Fish Creek Borehole (CDPHE Permit CO-0042161 Outfa11001), and it was not inspected. <br />Dischazge from the Fish Creek Tipple Pond (CDPHE Permit CO-0036684 Outfa11001A) was estimated at <br />0.005 cubic feet per second (2.2 gallons per minute)(1 inch in a 90 degree V-notch weir). Water quality <br />measurements were made at sampling sites on streams about the permit azea. See the map attached. <br />BACICFILL AND GRADING <br />Backfill and grading requirements aze associated with long-term mining facilities. No such activities were <br />observed or underway at the time of this inspection. <br />PROCESSING WANE <br />The coal mine waste bank (waste bank) was in good shape, and in compliance with the regulations. Processing <br />waste (waste material) was being hauled to disposal azea 2, and was being placed in echelon rows on the <br />surface of the waste bank to drain. Some remnant surge stockpile coal mine waste materials (those waste <br />materials stockpiled during the winter pending thawing and those wet materials in need of draining) were also <br />located at the southern end of the waste bank (Area 3). <br />SUPPORT FACILITIES <br />The discharge drop culvert of the road culvert above the Fish Creek Tipple sedimentation pond has sepazated. <br />C-1952-056 CP Inspection of April 2Q, 2005, Page 3 of 5 pages.
