Do not include a mining plan for <br />the D seam at the present time. Mining of the federal coal in [he D seam will <br />require a subsequent ammendment to your mining and reclamation plan in accord- <br />ance with the revised 30 CFR 211 regulations. <br />Our inspection revealed numerous problems on the ground. The problems fall under <br />the federal 717 regulations. Problems with sediment and erosion controls, <br />signs and markers, refuse disposal, topsoil salvage, etc. were cited on the <br />inspection report which will be forthcoming. We may want to solve some of these <br />problems at the next Board meeting prior to the final approval of your mining <br />and reclamation plan. <br />In the meantime please be advised that any further surface disturbance outside <br />of the approved 3 acre permit area will be construed as a violation, if it <br />is conducted without prior Board approval. Board approval will be sought for <br />the excavation of the water-line corridor and the completion of [he ventilation <br />shaft. <br />I will be pleased to work closely with you in the coming months.
