Box 226 <br />Della, CO 81416 <br />RE: Possible violations of mining and reclamation permit 1177-232 <br />Dear Mr. Linton: <br />The Red Canyon Coal mine now operated by Grand Mesa Coal Company was <br />inspected by staff members of the Colorado Mined Land Reclamation Division <br />on April 18, 1979. Several possible violations were discovered. <br />1. Areas outside of the approved permit boundaries have been <br />affected by mining activities. Access roads to the office trailer <br />and refuse disposal area, the office trailer itself, the new <br />ventilation shaft, and the water pipeline excavation appear to <br />lie outside the permit area. <br />2. The total surface area affected by current mining activities appears <br />to be greater than 10 acres. The limited impact permit is not adequate <br />for mining operations larger than 10 acres. <br />3. No evidence of topsoil salvage was found in connection with any <br />of the surface disturbances <br />These matters will be brought to the attention of the Colorado Mined Land <br />Reclamation Board as possible violations under sections 109,116 b 124 of <br />Article 32, Title 34 CRS 1973 as amended (Colorado Mined Land Reclamation <br />Act). We recommend that representatives of Grand Mesa Coal Company be <br />present at the May 23rd and 24th Board Meeting to be held at 9:00 am in <br />Room 110, Centennial Bldg, 1313 Sherman St., Denver, Colorado. <br />We further recommend that you submit a regular 112 Mining and Reclamation <br />permit application prior to the May Board meeting. The 112 application should <br />address all surface disturbance associated with current and proposed mining <br />activities. Please be sure to carefully address each of the items in the <br />federal interim regulatory program (part 717) in a separate section of your <br />regular 112 application.
