III. COMMENTS - COMPLIANCE- <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This was a complete inspection of the Marr Strip Mine and Walden loadout facility conducted on <br />Mazch 31, 2004 by Mike Boulay of the DMG. There was no representafive from Kerr Coal <br />Company present during the inspection. Weather conditions were cool and clear. Ground <br />conditions were mostly dry, and the mine site was almost entirely free of snow cover. There was <br />no activity at the mine site during the inspection. <br />Availability of Records <br />Records were reviewed at the Montgomery Watson Hazza office in Steamboat Springs on the <br />afternoon of Mazch 30, 2004. The most recent midterm review (September 2003) and associated <br />reclamation cost estimate could not be located in the records file. Please update the records file <br />with these two items. If necessary, the DMG can provide copies of the latest midterm review and <br />associated reclamation cost estimate. <br />Roads <br />The permanent light use road that accesses the site was dry and accessible. The road was <br />generally well maintained, but it did not appear that the road has been recently graded. There <br />were some minor ruts neaz the entrance to the mine site. With the exception of some minor <br />erosion along the ditch on the west side of the permanent light use road, road ditches were dry <br />and in good condition. <br />Hydroloeib Balance <br />All site sedimentation ponds were inspected. Pond A was full to within a few inches of the <br />primary spillway. Pond A continues to discharge a small amount of water probably due to a leak <br />in the standpipe or outlet pipe. The backside of the Pond A embankment had some minor rills <br />forming due to recent snowmeltlrunoff from the backside of the embankment. Pond B was <br />retaining a significant amount of fairly clear water but was not dischazging. The water level in <br />the pond was approximately 2-3 feet below the level of the dewatering orifice in the principal <br />spillway. The Pond B embankment is well vegetated and stable. Pond C was a retaining a small <br />amount of murky water that was partially frozen at the surface. The level of water in Pond C was <br />well below the principal spillway. The Pond C embankment is well vegetated and stable. Pond <br />D was retaining fairly turbid water at a level several feet below the principal spillway. The <br />culvert located beneath the permanent road that discharges to Pond D was dry and cleaz of <br />sediment and debris. Pond E was retaining slightly murky water approximately 1 foot below the <br />principal spillway. The level of water in Pond F was approximately 1.5' below the level of the <br />principal spillway. Pond G was holding only a few inches of muddy water. The embankments at <br />
