III. COMMENTS - COMPLIANCE <br />Below are corianents on the inspection. The corranents include discussion of observations <br />made during the inspection. Comments also describe any enforcement actions taken during <br />the inspection and the facts or evidence supporting the enforcement action. <br />This was a complete inspection conducted by Kent Gorham of the CDMG. This coal <br />operation is currently under a temporary shutdown due to market conditions. <br />Activities during the last 6 months have been focused on major earth moving tasks <br />and monitoring. The weather was clear and cool and ground conditions were <br />generally good with some wet areas due to recent rains. Mr. Bobby Steele of <br />Lorencito Coal Company accompanied me on this inspection. <br />Availability of Records <br />The public copy of the mine records is kept by Mr. Ron Thompson of Peak Project <br />Management (PPM) (719) 846-4975. Mr. Thompson's office is located at the Tri- <br />State Railyard office on the west side of Trinidad along Highway 12. The <br />insurance certificate expired on August 13, 2003. Mr. Thompson indicated he was <br />working on getting a new certificate. A registered professional engineer was <br />certifying the 2nd quarter excess spoil fill inspections. The blasting records in <br />the east storage trailer at the site should be brought to the PPM office with the <br />other mine records. The blasting permit expired on 12/31/2002 and the <br />administrative extension for 6 months granted by the Division of Mine Safety has <br />also expired. No new application or permit was available. <br />Signs and Markers <br />The mine identification sign was present irrenediately south of the new bridge <br />across the Purgatoire River that provides access to the site. The mine phone <br />number has been changed to the PPM phone number as requested in a previous <br />inspection. <br />Roads <br />Culverts along the Jeff Canyon haul road were clear and functioning as designed. <br />As mentioned previously, a culvert is necessary on the Lorencito Canyon haul road <br />south of its intersection with the Jeff Canyon haul road. Diversion of flow to <br />the south to Jeff Canyon in the western road ditch has not been successful due to <br />the existing grade of the road. Instead, water flows to the north in this ditch <br />and flows across the road surface of the Lorencito Canyon haul road at the <br />intersection. <br />The permanent road crossing the reclaimed area has been roughed-in. This road <br />will require culverts once the final post-mining topography is resolved during the <br />3 <br />
