III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />This was a complete inspection conducted by Joe Dudash of the Colorado DMG. Bill <br />Bear, Jr. represented the operator. The weather was dry and clear. The operator reported <br />that there had not been any major storm events recently. <br />Sedimentation Ponds <br />The water level in pond B was 2 inches above the primary discharge tube invert. The <br />water level in pond C was several inches above the primary. Pond D was dry. All of the <br />pond gated valves were closed. All of the spillways were functionai and all of the pond <br />embanlar-ents appeared to be stable. The vegetation on the embankments of ponds B and <br />C was somewhat sparse. They had only recently been reseeded. The water in pond C was <br />of a blackish color. Coal has been washed into the pond from the portal bench drainage. <br />However, no blackish color was seen at the discharge outlet point. Coal residue is <br />beginning to form a small delta at the inlet to the pond. <br />Ditches and Culverts <br />Culvert C-C9 has been replaced by a riprapped channel. The culvert had to be abandoned <br />since it had been clogged and could not be cleared. Water was running down the ditch <br />from two springs and was performing very well. The ditch at the base of the gob pile <br />needs a little touching up. The gob pile upland diversion ditch had sufficient capacity. <br />The diversion ditches at the coverfill stockpile were also functional. Culvert C-B 15, at the <br />west end of the gob pile haul road, needs some cleaning at the outlet. <br />At the main topsoil pile, the diversion ditch on the west side needs some touching up. On <br />the west side of the portal bench, the operator has directed the runoff through a culvert <br />and into culvert C-C 12. There were no problems with the other ditches and culverts. <br />Smal] Area Exemptions <br />The straw bales in the entrance road ditches and along the entrance SAE were functional. <br />The straw bales at the coverfill stockpile area need replacing soon, especially in the <br />
