<br />III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />year. Approximately 25 to 35 acres in central portions of the "A" pit were topsoiled in late <br />2004, and have not yet been seeded. Roy Karo indicated that this area had been scheduled <br />for seeding within the next week. <br />In the South Extension Area, final grading had been completed in Wadge Areas with 2004 <br />backfilling deadlines, and topsoiling had been completed or was in progress. Final grading <br />had been completed along the entire length (approximately 1500') of the Wadge ridgeline <br />pit, with a backfilling deadline of 2005. Topsoiling was in progress in this area. The <br />southern-most Wadge Pit, in the Pond 17 watershed (approximately 2400' in length) had <br />been fully backfilled, and appeared to be very close to final grade. This pit has a <br />2007/2008 backfilling deadline. Spoil ridges had been graded out and significant backfilling <br />had been completed along the middle Wadge segments in the Pond 16 watershed, with <br />2006 and 2007 backfilling deadlines. Rough grading was also contemporaneous in the <br />active Wolf Creek/Sage Creek mining area, with no more than one spoil ridge behind the <br />active pit. <br />In conclusion, the inspection verified compliance with contemporaneous reclamation <br />requirements of the regulations and permit. Backfilling and grading progress is well ahead <br />of permit deadlines, and the volume of material that will have to be moved to obtain final <br />reclamation grades is significantly less than that projected for purposes of the worst case <br />reclamation cost estimate. <br />Roads <br />Roads generally appeared to be properly maintained and in good condition. Several <br />segments of the Ridgeline Access road have not yet been completed in accordance with the <br />design approved in TR-49. This road is to be completed during 2005. PR-4 Stipulation 35 <br />requires completion of width reduction grading along the former "A" Road segment of the <br />Ridgeline Road by 9-1-05. "G" Road is also to be narrowed to post-mine configuration in <br />2005. <br />The old temporary road route from the ridgeline down to the aspen test plots is rilled, and <br />needs to be roughened and seeded. <br />Hydrologic Balance <br />Sediment control structures including sediment ponds, collection ditches, and topsoil <br />stockpile SAE sumps appeared to be properly maintained and functional. <br />Pond 005 water level was a few inches below top of primary riser; no discharge. <br />Pond 006 was spilling over top of primary riser; clear discharge, approximately 30 <br />gpm. <br />Pond 009 water level 5' below top of primary riser; no discharge. <br />
