III. COMMENTS -COMPLIANCE . <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was a complete inspection of the Yoast Mine conducted on August 20 and 21, 2007 by <br />Mike Boulay of the DRMS. Dennis Jones of Seneca Coa] Company (SCC) was present during <br />the entire inspection. Weather conditions were sunny and hot. Ground conditions at the mine <br />site were dry. The only activity at the site was at the Dragline Teardown area where a crew was <br />continuing to dismantle and scrap out the dragline. The majority of the dragline has been <br />removed. <br />Roads <br />Haul Road A remains in good condition with road ditches stable and culverts cleaz- of sediment <br />and debris. Two locations along Haul Road A that were inspected with Mr. Maneotis and Mr. <br />Roy Karo on July 18`" and July 19`h, respectively were revisited during this inspection. These <br />locations are Culvert YA 4 and YA 3A along the haul road. At Culvert YA 4 on the outlet side a <br />significant gully had formed approximately 5 feet deep beneath the fence line along the permit <br />boundary. This was adequately repaired by regrading the gully, adding riprap to the outfall of the <br />culvert and placing turf reinforcement mat to control future erosion on Mr. Maneotis's property. <br />The repaired gully and fence line are shown in the attached Photo Number 1. At Culvert YA 3A <br />sediment approximately 2-2.5 feet deep had built up against the fence. SCC repaired the <br />impacted fence by raising the fence up so that it is at its original level above ground surface. The <br />inlet to Culvert YA3A was also dressed up and the drainage to the culvert was improved. This <br />repaired fence and culvert inleUdrainage are shown in Photo number 2. <br />The work to narrow Haul Road B is continuing and nearing completion. The access into the <br />North Pit is blocked on the lower west end by construction of a new shrub plot. The former light <br />-use road has been reclaimed, making access into the North Pit area difficult. The possibility of <br />changing the light-use road location and grade were discussed during the Phase I bond release <br />inspection conducted in October 2006 due to the likelihood that portions of the road in its present <br />configuration could not meet the vertical alignment requirements for light-use roads. <br />Hvdroloeic Balance <br />All sedimentation ponds were inspected. Dennis Jones conducted his routine quarterly sediment <br />pond inspection of 011 A during this DRMS inspection. Sediment Pond O11A in the North Pit <br />was retaining at a level approximately 4.6' below the principal spillway. The pond inlet, <br />discharge structure and embankment were all stable. Sediment Ponds 010, 011, 013, and 014 <br />were all retaining water but not discharging. Pond 012 was full and discharging a small amount <br />of clear water. No additional movement was noted on the slide damaged area above Pond 012. <br />
