The problems should be corrected by the dates given, or they will become possible violations. The possible <br />violations should be corrected by the dates given to reduce their severity when considered by the Mined Land Reclamation <br />Board. The operator had disturbed 20 acres at the North LaPoudre Pit in the absence of a mining and 10/29 /03 <br />reclamation permit as required by Section 34-32.5-109(1). <br />PB or PV: ~tL <br />TOPIC(S): fie, <br />FN <br />Corrective action: Post an interim reclamation bond of $50,000 (20 acres x $2,500/acre) for 20 acres - - - <br />of disturbance and complete one of the following on or before October 29, 2003: 1) File a new <br />Regular 112 Application for the disturbances noted in this report and any future or additional <br />disturbances planned by the operator, or 2) Submit a written request for a reconsideration hearing, as <br />required by Rule 4.1(2), before the Colorado Mined Land Reclamation Board on or before November <br />19-20, 2003 and complete all re-publication and re-notice requirements prior to the reconsideration <br />(Please note that prior the hearing the applicant must re-publish, re-notice adjacent landowners, and <br />address any new permanent man-made structures within 200 feet of the affected land. If any <br />surface owners, easement owners, and owners of structures within 200 feet are different than what <br />was submitted in the original application, then new maps and exhibits will need to be submitted to the <br />Division.
