A site inspection was conducted in response to a request, via telephone, <br />from Jeff Gregg of Hall-Irwin and as a follow-up to a problem noted in the <br />Division's previous 6/27/03 inspection report. Jeff Gregg of Hall-Irwin <br />was present during the inspection. The site is located in Weld County <br />several miles west of Windsor, immediately south of State Highway 392. The <br />site is also adjacent to the 178-acre LaPoudre Sand & Gravel Pit, Permit <br />No. M-1983-090. <br />2. As noted in the Division's previous 6/27/03 inspection report, the status of the North LaPoudre pit is "awaiting <br />warranty". The Division previously approved Hall-Irwin's Regular 112 Application for the North LaPoudre site on February <br />20, 2001 and set the amount of financial warranty required at $240,000. More than 365 days have lapsed since the <br />application was approved. As of 9/4/03, the Division had not received a financial warranty in this amount and a mining <br />and reclamation permit had not been issued by the Division. (Please note that Rule 4.1(2) requires that if the <br />performance and/or financial warranties are not received within one calendar year of approval of an application for any <br />new permit, amendment or conversion, the Board shall hold a hearing to reconsider the previous approval). <br />3. The site inspection revealed that Hall-Irwin had excavated 2 small ponds with a total surface area of 10 acres and had <br />disturbed an additional 10 acres of surrounding land, in the absence of a mining and reclamation permit. Mr. Gregg <br />acknowledged that Hall-Irwin Corporation had checked their records and confirmed that no financial warranty had been <br />submitted to the Division for this site. The mining of the site in the absence of a mining and reclamation permit was an <br />unintentional oversight on the part of Hall-Irwin Corporation. Mr. Gregg indicated that Hall-Irwin has no immediate plans <br />for further excavation at the site. The shoreline of the 2 ponds had been graded to finish contours with 3:1 slopes and <br />surrounding areas need to be topsoiled and revegetated. There was also a large stockpile area to the west with <br />construction waste. The total acreage of disturbed land in need of reclamation (topsoiling, discing, and revegetation) was <br />estimated to be 10 acres. There was approximately SO acres of exposed groundwater in the 2 unlined ponds. A copy of <br />this report is being forwarded to the Office of State Engineer (OSE) for review and a determination of Hall-Irwin <br />Corporation's compliance with OSE permitting requirements. <br />4. The Division considers the disturbances noted in Item 3 above to be a possible violation of Section 34-32.5-109(1) of <br />the Colorado Land Reclamation Act for the Extraction of Construction Materials which states: "Before engaging in a new <br />operation, an operator shall first obtain from the Board or Office a reclamation permit pursuant to Section 34-32.5-110, <br />34-32.5-111, or 34-32.5-112. A Reason to Believe letter will be sent to Hall-Irwin Corporation and this matter will be <br />scheduled for consideration before the Colorado Mined Land Reclamation Board at the October 29-30, 2003 meeting, or <br />September 23-24, 2003 meeting if requested by Hall-Irwin Corporation.
