The possible violations should be <br />corrected by the dates given to reduce their severity when considered by the Mined Land Reclamation Board. The inspector noted <br />on the previous page should be notified of all corrective actions taken. <br />PROBLEMS/POSSIBLE VIOLATIONS <br />AND <br />CORRECTION <br />DATE <br />Mining operations have excavated material surrounding a utility pole located at the east end of the permit area. The utility pole <br />is supported by an island of material. Side slopes of the "island" were steeper than 3H:1 V and did not appear stable. Exhibit <br />D -Mining Plan, states that the operation would not approach utility poles closer than 50'. Rule 6.4.19 states that where the <br />operation will adversely affect the stability of any significant, valuable or permanent man-made structure located within 200' of <br />affected land, the applicant may either: <br />lal provide a notarized agreement between the applicant and the person(s) having an interest in the structure, that the applicant <br />is to provide compensation for any damage to the structure; or <br />Ibl where such an agreement can not be reached, the applicant shall provide an appropriate engineering evaluation that <br />demonstrates that such structure shall not be damaged by activities occurring at the mining operation. <br />DMG records do not contain the information required by Rule 6.4.19 for the utility poles or the buried gas pipeline which crosses <br />the permit area. <br />CORRECTIVE ACTION: Ensure appropriate support of utility poles by observing setback distance of 50' as stated in Exhibit D - <br />Mining Plan. Beckfill existing "island", compact backfill and grade slopes to 3H:1 V and revegetate with approved seed mix. <br />Please provide the informatlon required by Rule 6.4.19 for the buried gas pipeline and the utility poles located on the west side <br />of CR-G end on the north side of CR-L. <br />2/29196 <br />PB or PV PB <br />TOPICISI BG <br />MP, RS, _ <br />2. Weeds were not observed at the active pit area but were abundant through out the reclaimed portion of the permit area. The <br />operator needs to perform weed control measures on the affected areas of the operation. Rule 3.1.1016) states that weed control <br />shall be employed for ell prohibited noxious weed species, and whenever invasion of a reclaimed area by other weed species <br />seriously threatens the continued development of the desired vegetation. Weed control methods shall also be used whenever <br />the inhabitation of the reclaimed area by weeds threatens furtMr spread of aerioua weed pests to nearby areas.
