The problems should be corrected by the dates given, or they will become possible violations. The possible violations should be corrected by the dates given to reduce their severity when considered by the Mined Land Reclamation Board. The inspector noted on the previous page should be notified of all corrective actions taken. PROBLEMS/POSSIBLE VIOLATIONS AND CORRECTION DATE Mining operations have excavated material surrounding a utility pole located at the east end of the permit area. The utility pole is supported by an island of material. Side slopes of the "island" were steeper than 3H:1 V and did not appear stable. Exhibit D -Mining Plan, states that the operation would not approach utility poles closer than 50'. Rule 6.4.19 states that where the operation will adversely affect the stability of any significant, valuable or permanent man-made structure located within 200' of affected land, the applicant may either: lal provide a notarized agreement between the applicant and the person(s) having an interest in the structure, that the applicant is to provide compensation for any damage to the structure; or Ibl where such an agreement can not be reached, the applicant shall provide an appropriate engineering evaluation that demonstrates that such structure shall not be damaged by activities occurring at the mining operation. DMG records do not contain the information required by Rule 6.4.19 for the utility poles or the buried gas pipeline which crosses the permit area. CORRECTIVE ACTION: Ensure appropriate support of utility poles by observing setback distance of 50' as stated in Exhibit D - Mining Plan. Beckfill existing "island", compact backfill and grade slopes to 3H:1 V and revegetate with approved seed mix. Please provide the informatlon required by Rule 6.4.19 for the buried gas pipeline and the utility poles located on the west side of CR-G end on the north side of CR-L. 2/29196 PB or PV PB TOPICISI BG MP, RS, _ 2. Weeds were not observed at the active pit area but were abundant through out the reclaimed portion of the permit area. The operator needs to perform weed control measures on the affected areas of the operation. Rule 3.1.1016) states that weed control shall be employed for ell prohibited noxious weed species, and whenever invasion of a reclaimed area by other weed species seriously threatens the continued development of the desired vegetation. Weed control methods shall also be used whenever the inhabitation of the reclaimed area by weeds threatens furtMr spread of aerioua weed pests to nearby areas. A Gst of noxious end problem weeds and control tachnigws to these species un be obtained from the County Exbnsion Sarvics, tM Coumy Weed Control District Offles, or tM local offks of the Soil Canasrvation Service.
