Lent. o', idalt~rai f;asocru~~ <br />We feel that N.O.V. 83-25 should not have been written and that <br />it should be vacated prior to assessment. We feel that taking into <br />account the low environmental hazard potential and other circumstances, <br />we were not out of line in asking for another week extension to the <br />compliance date of July 15th. <br />Concerning the potential environmental hazard, we feel that it <br />was low enough to warrant another week. The ditch has been in the <br />same condition since installation three years ago. The reverse graded <br />portions have never collected enough water to overflow their banks. If <br />the diversions had overflowed, the water would have ended up in the <br />sediment pond. The maximum area of drainage influence affected by the <br />reverse grade was 4 acres. The maximum rain in a 24-hour period in July <br />from 1951-1973 was 1.15", compared to the system design for 2.2" <br />The pond would have easily held a heavy July storm. <br />We feel that a reasonable attempt was made to get the ditch graded <br />to meet your time requirement. We did not succeed, so we requested <br />another week. I do not show a receiving date for the inspection in the <br />Delta office, but I did not see it until July 1st. With a week of <br />vacation starting the next day, I contacted the backhoe operator on <br />July 11th, ao no one else was familiar enough with the diversion to <br />instruct the operator in my absence. Archie Peterson of Peterson <br />Excavating was contacted Monday, July 11th. On Tuesday, July 12th, <br />Brad Peterson, Manager, scheduled July 14th or 15th. An operator and <br />backhoe were here July 15th. Upon reviewing the irork, the operator <br />suggested that we use their small dozer, vrhich o-rould be available <br />July 20th or 21st. Considering the disturbance that would occur and <br />the added time requirement for setting up the backhoe below the ditch <br />-continued- <br />
