III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations <br />made during the inspection. Comments in Section IV describe any enforcement actions <br />taken during the inspection and the facts or evidence supporting the enforcement action. <br />Note: The permanent bridges are in disrepair. A reduced level of maintenance, sufficient for <br />foot traffic, has been approved. <br />Repair of a sign was an item of interest from a previous inspection. Also, a current certificate of <br />insurance, and Phase II Bond Release documentation needed to be placed on file. A Rill and <br />Gully survey was on file, but not found, during a previous inspection. <br />Concerns identified as a result of this inspection include the replacement of the permrttee <br />identification sign on the Stony Ridge road entrance and removal of a tree in the emergency <br />spillway of the Mine Waste Disposal Sedimentation Pond <br />This inspection was of reclamation work involved (Rule 3.03.2(2)) related to a Phase III Bond <br />Release application submitted by the permittee, and a coal complete inspection <br />(Rule5.02.2(2)) of the permit site. In addition to Mr. Jim Stover (permittee), Mr. Henry Austin of <br />the Western Regional Coordination Center, Office of Surface Mining, and Mr. Daniel <br />Hernandez, of the Colorado Division of Minerals and Geology, accompanied Mr. Byron G. <br />Welker on this inspection. With regard to bond release, reclamation work remaining at the site <br />includes removal of the bases of four water-monitoring flumes, and, upon approval by the <br />Division, reclamation of two ground water monitoring wells, removal of disturbance boundary <br />markers, and removal of signage. <br />Pictures taken and referenced in this report are on electronic file at the Division, numbered 25- <br />02-08-06-XXX.
