<br />Seneca IT-W Mine; p~. 2 <br />The DOW has suggested this, and I commented that I was aware of these mitigation <br />practices being conducted in other Western states, as recommended by their <br />respective state wildlife divisions. These mitigation areas do not carry SMCRA <br />liability in other states that I am aware of. <br />We began the field inspection with Mr. Karo and made stops/observations of the <br />following: Pond I6 that was stable at the embankment, and we noted some minor <br />erosion maintenance necessary at the pond inlet areas. Slight discharge from this <br />pond. Stop at South Wadge Pit in the South expansion area with an overlook to the <br />proposed Wolf Creek /Sage Creek permit revision no. 3 proposed expansion area. <br />Reviewed the proposed pond 171ocation and observed several elk and a hawk in this <br />area. Stop at the eastern end of Pit A (DMG issued a NOV here for spoil on the <br />downslope from a blast. The area is stable.) The permittee has made very significant <br />progress toward completed rough to final backfilling /grading in several pits on the <br />mine the last 12 months, including Pit A. Topsoil /seeding in Pit A next year. In this <br />area, and others, we noticed raptor protection on all electric line poles, and <br />appropriate spacing on fencing (10 in. between strands of wire) as required in the <br />wildlife protection plan. Stop at Pit D that also will have completed final grading this <br />year. Pond 5 was inspected, is stable, and has a historical spring box developed <br />downhill from the pond embankment toe, and the spring box was discharging. <br />Inspected Pond 6, it is stable, with a trickle discharge, and some small Canada thistle / <br />hounds tongue infestations are evident at most sediment pond locations. The <br />permittee committed to spraying the noxious weeds. <br />We inspected Pit B at the location of the road to the Meridian oil well. Mr. Shevling <br />indicated on July 18 that a Technical Revision was 2 to 3 weeks from completion and <br />submittal to DMG that includes a relocation of this temporary road to the oil well, a <br />request to leave permanent access roads in the Pit B & D areas as final grading is <br />occurring there as indicated above, and a request to use a highwall miner in <br />completed stripping azeas. We overlooked the completed Pit C area, which has good <br />slope contours and slope blending into undisturbed areas, and a well located <br />permanent impoundment. We concluded the field inspection by reviewing the two <br />sediment ponds in the Sage Creek drainage azea. They aze both stable, well below <br />discharge levels, and both receive very minimal disturbed area runoff These ponds <br />are both well located for eventual permanent impoundments. <br />On July 18 we concluded our permitting /environmental monitoring records review <br />which included the following: DMG permit renewal no. 3 for permit C-82-057 that <br />expires 12/31/05. The most recent Proposed Decision and Findings of Compliance are <br />dated 11/3/1999, Annual reports are available for inspection. Current bond amount is <br />$7,300,000 set via TR 40 for permit renewal no.3. The required rill and gully survey <br />has been updated and is current. Haul road certifications are available in the approved <br />permit. <br />
