The problema should be corrected by the dates given, or they will become possible violationa. The poeaible violations should be corrected by the dates given to reduce their severity when considered by the Mined Land Reclamation Board. The inspector noted on the previous page should be notified of all corrective actions taken. DHOHL~QB/PO99IHL8 VIOLATIONH AND CORRHCTIVB ACTIONS Pond No. 5 exposes groundwater, which requires a substitute supply plan or plan of augmentation issued by the OSfi. Such plan is necessary to meet the approved postmining land use. CORRSCTIVS ACTION: The operator will need to demonstrate compliance in regard to water rights, and provide the Division with an approved augmentation plan or~subetitute water supply plan issued by the Divieioa of water Resources, Office of the State 6ngiaeer. Demonstration of compliance with the OSS moat be submitted by July 15, 1003. The reclaimed pond configuration (for Pond #5) is different than what was approved in the reclamation plan. CORRHCTIVB ACTION: The operator will need to submit a revision to the permit depicting the actual configuration of pond #5. The revision must be submitted no later than July 15, 1003. The operator .failed to revegetate the area immediately north of Pond No. 5, thus allowing annual weeds to dominate the site. CORRBCTIVH ACTION: The operator will need to control the weeds and revegetate the disturbed area either this spring (if time allows) or no later than this fall with the approved seed mixture. Proof of compliance must be submitted in the form of receipts or photographs by November 11, 1003.
