III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />North Portal Vicinity <br />Various locations along the North Portal Area upper diversion ditches require repair, including lower end <br />of steep upper segment of East Diversion (significant downcutting), and lower end of West Diversion <br />(approximately 30 feet upstream from the 24" Haul Road 4 culvert), which has scoured around the <br />cobble installed last year. Grading and rock installation will be necessary in both locations. <br />Lower portions of the channel that drains the reclaimed powder magazine site also need repair. <br />Rock was washed out of the steep corner section upstream from the old concrete structure, exposing <br />the fabric underliner, and will need to be restored. Also, the lower segment from the concrete structure <br />down to junction with the North Portal West Diversion has scoured along the bottom and sides of the <br />channel. Grading and installation of riprap or other protective material appears to be warranted. <br />• Berm repairs noted to be necessary in the previous inspection report, near Topsoil Pile #2, had been <br />properly completed. <br />• The SAE silt fence, as well as perimeter collection ditches and perms appeared to be in good condition. <br />Sediment Pond 13 was muddy but had no standing water. <br />• Coal Creek appeared to have had significant flow, but was not running at the time of inspection. The <br />riprap transition structure near Pond 13 was in good condition. <br />• CBA-1 sump was muddy with no standing water. <br />• Water was ponded along the road ditch in the immediate vicinity of the Haul Road 4 crossing of coal <br />creek, near the North Portal Area, where the ditch had been repaired after the previous inspection. <br />Additional grading of the ditch is warranted, to establish positive grade to the ditch outlet <br />located south of the area of ponding. <br />Road ditch maintenance is also warranted in the area of the sharp ditch curve at the intersection <br />of Haul Road 4 and Haul Road 5, to clean out sediment accumulation (particularly along a short <br />segment of the ditch along HR-5, immediately west of the corner). <br />CBA-2 <br />Rock lined drainages were in good condition. <br />• Sediment Pond 11 was muddy, no standing water. <br />CRDA-1 <br />Terrace drains appeared to have functioned well and were in good condition. <br />Perimeter ditches functioned properly. Maintenance is warranted along the section of the NW Collection <br />perimeter ditch, east of the 30" culvert, along the segment of ditch that closely parallels Hauyl Road No. <br />5. Along this segment of the ditch, saturated/compacted clumps of straw and tumbleweed have partially <br />obstructed the ditch in a couple locations, and a clump of rabbitbrush has partially obstructed the ditch in <br />another location. These obstructions need to be cleared out to restore the design capacity of the <br />ditch, and to prevent further accumulation of sediment and debris. <br />There was a shallow pool of water in the middle part of Pond 6. <br />A brood of 10 or 12 chukars was flushed along the southeast slope of the reclaimed refuse area. <br />CRDA-2 <br />• CRDA-2 slopes and ditch segments visible from HR-4 and CRDA-1 were observed and no problems <br />were evident. Recently repaired riprap outlet segments of the Upper diversion east and west ends <br />appeared to have held up well. <br />• The water bar on the temporary road on the reclaimed refuse slope appeared to have been repaired as <br />previously requested. <br />4 <br />
