III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations <br />made during the inspection. Comments also describe any enforcement actions taken during <br />the inspection and the facts or evidence supporting the enforcement action. <br />This was a complete inspection conducted by Joe Dudash of the Colorado DMG. The operator <br />was represented by Mike Kelly. Snow covered the higher elevations of the mine site. <br />Facilities <br />The downhill conveyor and coal stockpile are operational. The haul trucks are filled by front end <br />loaders and, then, driven to the Bowie No. 1 train loadout. Because the loading operations are <br />being performed near old Highway 133, the coal dust is 5nding its way to the highway. <br />Unfortunately, the coal stockpile is situated right next to the edge of the coal stockpile bench. It <br />would be better if coal was not piled so close to the bench edge. The operator has put up a wind <br />fence on the coal stockpile bench, between the coal stockpile and the highway. However, the <br />wind fence can only do so much. The haul trucks are tracking coal dust onto the highway as well. <br />The operator had tried to use a street sweeper but the vacuum, apparently, was not working. The <br />operator needs to clean up the coal fines along the highway and highway shoulder, one way or <br />another, and do a betterjob of controlling the fugitive dust in the first place. <br />Some time this week, the operator will bring a loading conveyor and loading bin on line. The <br />loading system is located to the back of the coal stockpile bench. The operator plans to gravel the <br />truck loop on the coal stockpile bench. Both the method of loading coal and the location of the <br />loading operation should decrease the fugitive dust on the highway. <br />According to the operator, there has been some difficulty getting trains lately for coal shipments. <br />As a consequence, the coal stockpiles at the bottom of the hill and on the portal bench are fairly <br />large in site. There was one small breech in the edge berm of the lower coal stockpile bench, due <br />to a construction project at the coal stockpile exhaust fan. The breech will be filled in once the <br />project is finished. <br />There were no problems with any of the facilities. A new storage structure is being constructed at <br />the material storage area north and adjacent to the main topsoil stockpile. The downhill conveyor <br />runs fairly quietly. There were no leaks at the fuel bam. Containment berms were functional. <br />
