The operation
is no longer being actively worked and is entering the reclamation phase of mining.
A conference with the Operator (Al Frei) , Landowner (William and Dona Mae Bromley),
Operator's consultant (Steve O'Brian) , and Landowner's attorney (Janice Hofmann Clark) was
held prior to the inspection. The landowner and operator are currently trying to resolve
what further reclamation must be done at the site, and whose responsibility certain tasks
are. DMG explained the terms of the current permit and the requirements which the Operator
must fulfill at the site prior to release from his financial and performance warranties.
Specifically, all slopes must be eloped at 2H:1V or lees, and at least one foot of topsoil
must be spread over disturbed portions of the site. The end land-use of this Bite was left
undefined at the time the permit was granted, and it was stated that future fill operations
might take place at the site. The inspection corunenced at 3:30 PM.
1. A sign with the permit number on it, and boundary markers delineating the permit area,
must be installed within 30 days.
2. The trash and concrete on Parcel A, north of the excluded area, must be covered with at
least 1' of topsoil.
3. Knapweed is a problem on Parcel A, and must be treated to prevent it from spreading.
4. The rebar present on Parcel A must be dealt with so it is no longer a safety hazard.
5. All sides of the site must have at least 2H:1V slopes or shallower.
6. There is currently a shortage of topsoil on this site. The two topsoil stockpiles present
were measured with a measuring wheel and abney level, and the volume present was calculated
at 3090 CY. It is estimated that the amount needed to cover the site with 1' of topsoil
will be 20,973 CY, assuming approximately 13 acres of disturbed area will be topsoiled. This
leaves a deficit of 17,883 CY of topsoil.
7. The current bond of $20,900 is inadequate. The attached cost estimate outlines the
calculated labor, equipment and materials costs.
I & E Contact Address cc: Carl B.
