(Page 3) <br />MINE ID # OR PROSPECTING ID $ M-87-163 <br />INSPECTION DATE 12/05/95 INSPECTOR'S INITIALS RCO <br />the open drums, and found traces of a heavy Tube-type oil on the "dip sticks". All labeling <br />on the drums ie gone, so their contents was not able to be determined. <br />These drums were indicated to this inspector by the operator at the 8/21/95 inspection. The <br />operator stated that they had been there many years, were probably present from when <br />maintaining the boiler was necessary, and had been discarded ae empties at the creekeide. <br />He stated that they have never been disturbed by him. There were no permit boundary markers <br />present to determine if these drums were actually in the permit. These drums are located <br />very close to the boundary, and if they are outside the permit, the Division may not have any <br />jurisdiction over their safe removal and disposal. <br />The lack of permit boundary markers is noted ae a problem at this time, and they must be <br />placed onsite when the area is accessible in 1996. See the last page of the report for the <br />corrective actions for this problem. <br />Related to that problem is the problem of adverse impact to the hydrologic balance and <br />presence of toxic materials, involving the presence of these drums. If the careful placement <br />of the boundary markers shows that the drums are outside the permit, this problem will be <br />deemed corrected by this Division (even though their removal and disposal may still be <br />required by another agency). If the drums are in the permit, they must be dealt with, by <br />first sampling their contents for identification, pumping them out, removing the empty drums <br />from the creek, and properly disposing of containers and contents. The operator moat propose <br />a plan to accomplish this, by the date shown on the last page of the report. After <br />conversation with the Colorado Department of Public Health and Environment (CDPHE), it is <br />felt that this situation should be corrected as soon ae possible. If safe removal can be <br />accomplished before high spring runoff in Gold Creek, a commitment to such scheduling should <br />be made part of the plan. <br />In light of the potential haz <br />boundary shows that these drums <br />required. The coat to perform <br />calculated by the Division and <br />drums are safely removed. The <br />report.
