Please see page 4 for compliance due dates Mr. McNaney expressed concern that water builds ug on a low spot on southeast corner of the property. The low spot on t:he property does not drain into the ditch or culvert that is roughly 20 feet away- This low spot never drained into the historic drainage channel since the historic channel is upslope of the property. In addition, this low area has not been created or altered by the operator and is outside the permit area. Based on this information, the operator is only responsible for maintenance of the reconstructed drainage channel and the culvert. It :should also be noted that a small pond has been constructed in the natural drainage Swale on the McNaney property by the landowner, and the fill that came out of the pond was replaced on the east further restricting the natural Swale. The operator will also need to address reclamation of the culvert corridor. The Division does not believe this structure should remain in place once the site has been reclaimed. The maintenance of the culvert will be too great as a permanent feature. An open channel Swale should be reconstructed in this area for the final reclamation..
