III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This was a complete inspection conducted by Joe Dudash of the Colorado DRMS. No one represented <br />the operator during the field inspection. Bill Bear represented the operator during the records check. <br />Well Field <br />The mine ID sign was up at the entrance and the surface disturbance markers were up around the site. <br />The road leading in was in good condition. There were no problems at the well house. There are, <br />however, quite a few thistle plants on the topsoil stockpile and these should be sprayed. Also, the <br />topsoil sign is offof its post. <br />Run-of Mine (ROMI Stockpile <br />The graveled haul road was in very good condition. The mine ID sign and surface disturbance markers <br />were up. However, the topsoil stockpile sign was off of its post and should be put back up. Culverts <br />and ditches were functional. The sediment pond was dry. The pond embankment was well vegetated <br />and was stable. <br />Unit Train Loadout <br />There were no railcazs at the train Loadout. All three entrances were open and each gate had a mine ID <br />sign up. There is mining equipment being stored at the site. The sediment pond was dry and the <br />sediment control collection and diversion ditches were functional. Irrigation water was flowing in the <br />Farmers Ditch culvert beneath the sediment pond and in the diversion ditches and culverts in the center <br />portion of the Loadout. <br />Hiehwav Coal Stocknile <br />No slope instability or erosional problems were observed at this temporarily reclaimed site. The mine <br />ID sign was up at the entrance and surface disturbance markers were up aoound the disturbed area. The <br />sediment pond was dry and the straw bales were around the inlet of the west side culvert. <br />East Mine <br />The front gate was closed and locked. The mine ID sign was up on the gate. The paved haul road, and <br />dirt access and light use roads were in good condition. The operator is continuing to break up the <br />concrete on site. Power poles had been cut down and were on a semi ready for transport offsite. Metal <br />scrap had been loaded onto another semi for transport. <br />The culverts were clear and the mine site ditches had sufficient capacity. There was no water in any of <br />the four bin wall ponds. The primary dischazge tube gates on the upper three ponds were open and the <br />lower one was closed, as designed. <br />
