Co~n~nents - Compliance <br />Below are particular issues with regard to any of the above compliance items. <br />Enforcement actions resulting from failure to comply with the Act, Rules and <br />Regulations, and the permit also are identified below. <br />1. Mr. Mitchell indicated that a new coal stockpile was to be built at the <br />mine entrance road adjacent to Hubbard Creek. This area was previously <br />disturbed by the operator and had been used to stockpile coal waste in the <br />past. The area is within the approved MLRD permit boundary and is designated <br />as a storage yard. <br />I told Mr. Mitchell that he should check to ensure that the new stockpile is <br />covered under Blue Ribbons' Emissions Permit. Upon returning to the office I <br />contacted Mr. Scott Miller (Department of Health, APCD, 125 North 8th Street, <br />Grand Junction, Colorado 81501,(Telephone: 245-2400) concerning the Emissions <br />Permit in question. Based on my description of the operation and his cursory <br />review of the application it was his preliminary opinion that a new permit for <br />the stockpile would be needed. We agreed that Blue Ribbon should address this <br />concern with the Air Pollution Control Division prior to constructing the <br />pile. I notified Mr. Julian Mitchell of Blue Ribbon Coal Company concerning <br />this issue by phone on January 31, 1983 so that prompt resolution would occur. <br />If a new permit is in fact required, Blue Ribbon should forward a copy of the <br />final and approved Emissions Permit to MLRD when available. <br />2. Sedimentation pond engineers certificaton needs to be submitted. Mr. <br />hlitchell said they are nearing completion of the certification. <br />3. The road warning sign needs to be installed at the mine entrance, also the <br />permit number should be changed to C-047-81. <br />4. Coal was noted spilled on the Hubbard Creek road below the mine and, <br />although a small amount, should be cleaned up. <br />5. Mine records were available with the exception of the Emissions Permit <br />which could not be located. This permit needs to be on file at all times. <br />6. The grade at the corner of the office/shop area needs to be increased to <br />contain water from the portal bench and to prevent water from flowing down the <br />access road. Currently some pad drainage flows down the road which only <br />increases the maintenance burden put on the access road. <br />
