~.::.,. <br />CERTIFICATE OF INSURANCE: Liability insurance, policy number <br />94-0308, was issued on 11/01/94 and expires on 11/01/95. The <br />general aggregate amount of coverage is $2,000,000.00. <br />OWNERSHIP AND CONTROL: The Albuquerque Field Office received <br />an updated list of owners and/or controllers of Sun Coal <br />Company prior to this inspection. The Applicant Violator <br />System was not checked prior to this inspection but it was <br />determined during a May inspection that the information in <br />this system needed to be updated. <br />BOND: Surety bond number SU 34733 in the amount of $348,777.00 <br />is provided by Utica Mutual Insurance Company. <br />NPDES OR DISCHARGE PERMIT: The Colorado Department of Health <br />has issued discharge permit number CO-G-850012. The permit <br />was issued on 06/19/92 and expires on 06/30/97. The current <br />permit allows 3 discharge points. No discharges were reported <br />for the 3rd quarter of 1994. other quarters checked found <br />discharges to be in compliance with the permit. No other <br />surface or ground water monitoring or reporting is being done <br />at the Meadows mine. <br />POND AND IMPOUNDMENT INSPECTIONS: Quarterly inspections have <br />been conducted during each quarter of 1994 on all ponds <br />remaining on the mine. <br />IMPOUNDMENT CERTIFICATIONS: All ponds with the exception of <br />the Northwest Sediment trap were depicted in as-built drawings <br />and certified. The Northwest Sediment trap was identified <br />during the May 94 inspection as not being certified and the <br />Division issued a Notice of Violation. The Division inspector <br />insured me that this work had been done and Mr. Ellison had <br />just misplaced the information in his office. <br />OTHER MONITORING: The rill and gully plan has been revised to <br />require monitoring twice per year. Backfill stability <br />monitoring is required to be done on a semi-annual basis as <br />well as a spring and seep survey. The revegetation monitoring <br />was last done on July 29, 1994. <br />RECENT PERMITTING ACTIONS: The reclamation of the facilities <br />area has reached final resolution with the documentation of <br />the desires of the land owner, Mr. John Eilts. Mr. Eilts <br />appeared before the Mine Land Reclamation Board and gave sworn <br />information as to what he desired to be left of the structures <br />at the facilities area. There had previously been a problem <br />with no written request from Mr. Eilts as to his desire for <br />the structures and how they would be used for the post mining <br />land use of light industrial. Sun Coal will now remove those <br />structures which the land owner has not requested to be left <br />and reclaim the area. <br />4 <br />
