Comments - Compliance <br />Below are particular issues with regard to any of the compliance items. <br />Enforcement actions resulting from failure to comply with the Act, Rules <br />and Regulations, and the permit also are identified below. <br />1. Upon inspection of the permit boundary and a discussion witn i4r. <br />Mitchell it was noted that the permit boundary has been clearly marked. <br />White PVC pipe is used as a marker. <br />2. Records were being kept on file and up to date at the mine. <br />3. The operator has installed a new pipe and inlet to drain the mine <br />bench. The pad has had some grading to establish positive drainage to <br />this drain. However, the iJ.'W. edge of the pad does not drain to the new <br />pipe. Either the old drain needs to be reestablished to control this <br />area, or the pad needs to be reyraded to ensure all runoff from the pad <br />does not pond or flow over the outslope. The original compliance date of <br />December 15, 1983 is still in effect to complete the drainage <br />modification. <br />4. The access road appeared well maintained, little or no rock debris <br />were noted in the roadside ditch. <br />5. The operator Yias a small truck size pile of coal on the switchback <br />pad for use by the employees. .4 r. fitchell was instructed to remove the <br />pile. Coal cannot be stored in this pad since it drains only to a cneck <br />dam not a sedimentation pond. Any remaining coal fines should be scraped <br />up and dumped on the waste pile. <br />6. The new truck scale and security guard shed has been completed. Work <br />was well done with no significant disturbance to the streambank noted. <br />7. The old truck scale does not appear to need any interim reclamation <br />at this time. However, a fence is needed to keep the public out of the <br />permit area. The fence should reduce the possibility of any damage or <br />dumping on the site. <br />8. Survey monwnents have been installed on the mine bench and outslope. <br />
