III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was a partial inspection of the Yoast Mine conducted on September 20, 2001 by Mike <br />Boulay of the DMG. Robert Shevling of Seneca Coal Company was present during the entire <br />inspection. Weather conditions were sunny and clear. Ground conditions were dry throughout <br />the majority of the site. Coal was being hauled from the mine site and the dragline was operating <br />in the Yoast South Area. <br />Roads <br />Road surfaces throughout the mine site were dry and in good condition. Haul Roads A and B <br />were very well maintained. Road ditches and road drainage runouts were dry. <br />Hydrologic Balance <br />Sedimentation Ponds 010, and 012 were inspected. Both ponds were full and discharging clear <br />water a[ [he time of the inspection. A small crack was noted along the top of the Pond 012 <br />embankment. The crack has been observed in the past and is probably due to settlement of the <br />embankment. Please continue to monitor this and make repairs if necessary to ensure the <br />stability of the Pond 012 embankment. Construction of Pond 014 is nearly completed. <br />Construction of the emergency spillway was observed during this inspection. <br />Explosives <br />Notice of Violation CV-2001-009 was issued on September 6, 2001 for failure to comply with <br />the maximum weight of explosives to be detonated as determined by the scaled-distance <br />equation, and failure to obtain Division approval for the use of a modified equation to determine <br />maximum weight of explosives per delay. The abatement for this violation is to ensure <br />compliance with the scaled- distance equation for blasting, unless use of a modified equation is <br />approved by the Division in advance of blasting. <br />During this inspection, pre-blast surveys were reviewed at the mine site office. >n addition, coal <br />and overburden blasting records for the period July 3, 2001 through September 11, 2001 were <br />obtained and reviewed. Based on this inspection of blasting records, the Division conc]udes that <br />SCC is in compliance with Rule 4.08.4.(10) and mitigation measures have have been <br />successfully completed for the abatement of NOV CV-2001-009. <br />
