s <br />III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />A partial inspection of the Bowie Mine No. 1 was conducted by <br />Christine Johnston of the Division. Basil Bear representing the <br />operator accompanied me during the inspection. <br />Hvdroloaic Balance <br />The upper diversion ditch at the fan level has been repaired and is, <br />good working order. The silt fence in use as alternative sediment <br />control for the SAE at the fan level needs repair. The operator <br />expressed the desire to change the sediment control from silt fence <br />to another method, due to the constant maintenance required for the <br />fence. The operator is aware a revision would be needed to change <br />the sediment control. <br />The SAE at the west mine fan site was inspected. A berm is in use <br />to direct the water to hay bales and off the disturbed area. The <br />silt fence is still at the site and will be removed once vegetation <br />has been established on the pad. It appears that this method of <br />alternative sediment control is effective. <br />Currently in place are silt fences below the topsoil piles on the <br />outslope of the fill at the west mine portal. The SAE <br />demonstration allows the silt fences to be removed once vegetation <br />has been established. It appears that the topsoil piles do have a <br />good stand of vegetation and it would be appropriate for the fences <br />to be removed. The operator would like to remove these fences, <br />which I recommend, and will discuss this with the lead inspector. <br />An oil skimmer has been placed in the west mine pond. The pond <br />probably requires cleaning in the near future. The pond below the <br />refuse pile has been cleaned. We discussed the repair plan for the <br />bin wall ponds and inspected ponds 3 and 4. The material to <br />construct the earthen embankments would be borrowed from an area <br />adjacent to pond #4. <br />Support Facilities <br />The oil/lubricant storage area was inspected at the west mine. The <br />area is in good order, no spills were noted. At the time of the <br />inspection there were not many barrels being stored. The operator <br />has placed oil booms in the ditch adjacent to the storage area <br />which leads to the west mine pond. No oil sheen was noted in the <br />pond. <br />
