side of the cemetery, being careful to observe the agreed upon set-backs and mining depths. However, the <br />topsoil stripping along the southwest corner was close to the 10 foot set-back right at the corner. The single <br />strand wire being used to delineate the perimeter of the cemetery was off of one of the tee-posts along the <br />south side, however, this did not impact the cemetery since no additional disturbance had occurred in this <br />area. The track running through the cemetery from northwest to southeast is actually a livestock trail. The <br />landowner at some point cut the fence along the north side to facilitate the movement of horses across the <br />cemetery. This may also be the reason the single strand fence was off the tee-post along the south side. No <br />vehicle tracks were observed within the delineated area of the cemetery during this inspection. <br />With respect to the specific requests made on page 10 of the complaint letter; <br />1. The site will continue to be inspected at the same frequency as all other 1 12c permit sites which is once <br />every three to four years. <br />2. The operator will be required to erect an additional perimeter boundary marker around the cemetery <br />reflecting the previously agreed upon 10 foot buffer plus the additional 5 foot buffer verbally agreed to <br />with the landowner during the last inspection. <br />3. The set-back will be 5 feet from the existing single strand fence that the county previously erected. This <br />will provide aset-back from the nearest known grave site of more than. 15 feet but possibly less than 30 <br />feet. Mining must occur at no steeper than a 2H:1 V slope and must be no closer than the 15 foot off- <br />setfrom the cemetery which will be clearly delineated by the temporary fence. <br />4. Reclamation must occur as soon as possible once mining is completed including the areas where it may <br />be determined that topsoil was stripped closer than the set-back once the new markers are installed. <br />This request has not been placed on the Board Agenda as we believe the proposed remedies outlined in this <br />report; including the problem cited on page 4 and the subsequent technical revision that is being required in <br />response to the problem, will adequately address the concerns identified in the complaint letter.
