III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />Abatement of Breach #4 will need to include regrading and stabilization seeding of the scoured <br />section of Pond 9 collection ditch, and clean-out of the county road ditch segment (and culvert if <br />present) impacted by the breach. <br />Other <br />Pond 12 is the other sediment pond that receives significant drainage from active mining and <br />reclamation areas. Operator had not reported any problems from the storm event in the Pond 12 <br />watershed, but we viewed the pond and adjacent areas prior to concluding the inspection. The pond <br />contained water, pool elevation approximately 3 to 4 feet below the top of the spillway riser. The <br />section of collection ditch east of the Pond passes directly to the north of the active pit azea, and this <br />ditch segment was walked, due to the apparent potential for heavy runoff and sedimentation. The ditch <br />is a large "V" ditch that had functioned well, with no breaches or segments of significant scour or <br />deposition. Disturbed drainage had been properly conveyed to Pond 12. <br />7 <br />
