III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations <br />made during the inspection. Comments also describe any enforcement actions taken during <br />the inspection and the facts or evidence supporting the enforcement action. <br />Photo #2606 is view to south along 2700 Road toward Pond 8. #2607 is view to north along 2700 <br />road from the same photo point. #2608 is the grass lined collection ditch up-gradient of the breach <br />location (view to south). #2609 is the Breach #3 location. #2610 is the 18" CMP culvert inlet at the <br />lower end of the collection ditch, immediately north of Pond 8. #2611 is the outlet end of the culvert <br />(outlet submerged below water in Pond 8). #2612 is view of Pond 8 from south end of embankment <br />looking north. #2613 is view west from Pond 8 embankment, showing location where flow from <br />Breach #3 passed over 2700 Road and entered stock pond on west side of road. #2614 is a feedlot <br />located on a slope south of Pond 8. Flow from the feedlot area reported to the same location as the <br />Breach #3, and would have contributed sediment in addition to that which originated from mine <br />disturbance areas. #2615 is a view downstream to the west, along the draw below the stock pond <br />embanlanent. #2616 is view from the stock pond embankment to the east, towazd Sediment Pond 8. <br />Abatement of Breach #3 will need to include verification of proper design and functionality of <br />the outlet controlled culvert into Pond 8, and restoration of county road ditch segment (and <br />culvert if applicable) affected by sediment deposition from Breach #3. <br />Breach # 4 <br />Breach #4 occurred at the lower (west) end of Pond 9 disturbed area collection ditch. The breach <br />occurred at the inlet of a 3 culvert installation (3, 18" CMP culverts), which conveys collection ditch <br />flow beneath a road segment and into Pond 9, located a short distance further west. Operator indicated <br />that one of the three culverts (northern-most culvert) had become blocked by tumbleweeds. The <br />operator had removed the blockage from the culvert inlet prior to the inspection, but the glut of weeds <br />was piled adjacent to the culvert inlets. Ditch at the culvert inlet location was approximately 20 feet <br />wide and 26" deep. The culvert blockage likely caused or contributed to the breach at this location. <br />Disturbed area flow escaped the ditch at this location and flowed to the north, across the adjacent <br />county road ("BB Detour Road"). The disturbed flow passed out of the permit boundary <br />approximately 15 yards north of the ditch. The county road ditch was silted in along the width of the <br />flow path (approximately 30 feet), and there was a thin film of sediment across the county road, extend <br />into the scrubby rangeland across the road. There may be a culvert beneath the county road at this <br />location that was impacted by sediment deposition from the breach, but this was not verified during the <br />inspection. Flow from the breach would have entered Tuttle Draw drainage, approximately 150 yazds <br />distant. There was no detrimental impact to the upland rangeland. It is likely that there was significant <br />turbid flow in Tuttle Drainage when the breach occurred; such that downstream impact of sediment <br />laden discharge from the ditch breach would have been minimal. <br />Photo #2617 is the Breach #4 location, culvert inlets at western end of the Pond 9 collection ditch. <br />#2618 is a view to the north from the Breach #4 location, toward "BB Detour Road". Tuttle Draw <br />drainage is in the background (cottonwood trees along drainage channel). #2619 shows the segment of <br />the county road ditch outside the permit boundary that was silted in as a result of Breach #4. #2620 <br />shows the scoured lower section of the Pond 9 collection ditch up-gradient (east) of the breach <br />location. <br />6 <br />
