(Page 2) • <br />MINE ID # OR PROSPECTING ID # M-80-100 <br />INSPECTION DATE 07-13-99 INSPECTOR'S INITIALS CBM <br />OBSERVATIONS <br />This was a monitoring inspection done by Carl Mount as part of the Division <br />of Minerals and Geology routine inspection program. Photographs were taken <br />of the permitted area and surrounding areas. The site disturbance was <br />evaluated and determined to be included within the marked permit area. The <br />inspection was performed because of complaint letters received June 21 and <br />July 12, 1999 from Frank and Richard Estey, respectively. <br />There has been almost no change in the pit configuration since November 28, <br />1995. Broken asphalt and concrete have been hauled into the site and dumped <br />in the south side of the excavated area. This is cited as a problem that <br />must be resolved by no later than September 15, 1999. Backfilling the pit <br />with inert material is allowed under the Colorado Land Reclamation Act for <br />the Extraction of Construction Materials. However, notice must be filed with <br />the Division of Minerals and Geology prior to backfilling. Such notice must <br />conform to the requirements of Rule 3.1.5(9) enclosed. The operator must <br />file and DMG must approve such notice by no later than September 15, 1999 or <br />the material must be removed from the permit area. See PB 1 on page 3 of <br />this report. <br />It is probable that the $5,000 financial warranty is inadequate at this site <br />given the amount of material that must be backfilled into or hauled out of <br />the pit and the amount of topsoiling and seeding that must still be done. <br />DMG personnel will recalculate the bond in late August of 1999 to see what <br />bond is now required given site conditions. If the operator has photographic <br />evidence that reclamation work has been accomplished before that time, please <br />submit this evidence to DMG offices as soon as possible.
