III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />redistribution, and seeding in all areas of the Yoast Mine in accordance with the approved <br />backfill and grading plan and schedule depicted on Exhibit 19-1A by the abatement deadline of <br />October 2003. <br />Slides and Damaee <br />The slide area below the Haul Road D embanlanent above Pond 012 was inspected. <br />Notice of Violation CV-2003-008 was issued in July 2003 for: failure to comply with remedial <br />measures required by the Division and for failure to stabilize by vegetation or other means the <br />areas surrounding the Pond 012 impoundment. No additional work or remedial measures have <br />been implemented at the slide damaged azea since the time of the last inspection. Please <br />complete the following required abatement steps for the slide damaged area by October 20, 2003: <br />1) Reconfigure the slide azea to ensure stability as demonstrated by geotechnical analyses and <br />engineering designs; and 2) As this is an area of continuing failure, establish a monitoring <br />program to validate adequacy of corrective actions. <br />
