III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations <br />made during the inspection. Comments also describe any enforcement actions taken during <br />the inspection and the facts or evidence supporting the enforcement action. <br />H droloey <br />Ponds 1, 2, 3 and 4, as well as the ponds at the ROM pile, the West Ridge waste pile and <br />the train loadout were dry. There was very little water in the highway coal stockpile pond <br />and in the West Portal pond. The highway coal stockpile pond has a delta of coal fines in <br />it and may need cleaning soon. Pond inslopes and outslopes were erosionally stable. Pond <br />embankments and bin walls were geo-technically stable as well. Pond discharge <br />structures were functional. <br />All of the mine culverts were functional. However, two culverts will need some <br />maintenance soon. The culvert inlet right at the West Portal entrance needs clearing of <br />some rocks behind the culvert grate. Also, the area around the inlet to the west side <br />culvert at the highway coal stockpile has some coal fines that need to be cleaned up. In <br />addition, the berm at that same location needs to be made of soil, not coal fines. <br />All of the ditches had been recently cleaned and were fully functional. Straw bales need <br />replacement at two locations. The first location is at the outlet of the ditch on the <br />backside of the crusher/screener bench, before the ditch spills out into undisturbed land. <br />The second location is at the vain loadout loading bin, where the orchard road comes off <br />of the loadout bench. <br />Topsoil Stockpiles <br />No erosional gullying was evident on any of the topsoil stockpiles. Topsoil stockpile <br />signs were present. Vegetative cover ranged from moderate to good. <br />Gob Piles <br />There have not been any recent additions to the West Ridge waste pile. The West Ridge <br />waste pile is well vegetated and the collection and diversion ditches were functional. The <br />reclaimed gob pile was well vegetated as well and the diversion ditch was recently <br />cleaned. There were no signs of geo-technical instability at either of the waste piles. <br />
