III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations <br />made during the inspection. Comments also describe any enforcement actions taken during <br />the inspection and the facts or evidence supporting the enforcement action. <br />This was a complete inspection conducted by Joe Dudash of the Colorado Division of <br />Minerals and Geology. Basil Beaz represented the operator during a portion of the <br />inspection. The mine site was dry. The operator has recently cleaned ditches and culverts. <br />Siens and Markers <br />Mine ID signs were up at the appropriate locations and contained the correct information. <br />Surface disturbance markers were present around the mine site. <br />Roads <br />All of the roads aoound the mine site areas were in good shape. <br />Reclamation <br />The backfilling and grading operations at the Wes[ Portal continue. The earth moving <br />operations have proceeded to the point where the outside portion of the south bench area <br />can be dozed to the highwall area. The south topsoil berm will be moved and the upper <br />silt fence on the south-facing bench outslope will be moved downgradient in anticipation <br />of this operation. Additional silt fence will be placed on the north side of the bench azea. <br />The structures at the West Portal fan site have been demolished and taken offsite. The <br />vent shaft has been backfilled, although there has been some settling, which the operator <br />then filled. The fan site has been rough graded. The operator is anticipating more settling <br />of the vent shaft backfill so the fan site area has not been topsoiled yet. Sediment control <br />is by a berm and silt fence. A little more silt fence could be used south of where the <br />present silt fence ends and also where the road enters the fan site bench. When the area is <br />topsoiled, more silt fence will probably be needed. <br />At the East Mine, the structural demolition continues. The mine office building, all <br />conveyor sections and the warehouse are down. <br />
