III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the inspection <br />and the facts or evidence supporting the enforcement action. <br />This was a complete inspection of the Seneca II Mine conducted on March 15 and Mazch 16, <br />2005 by Mike Boulay of the DMG. Roy Kazo of Seneca Coal Company (5CC) was present <br />during the entire inspection. Weather conditions were sunny and warm on the afternoon of <br />Mazch 15a'' It was snowing on the morning of March 16a' when the inspection was completed. <br />Most of the mine site was snow covered. There were isolated azeas of drifted snow and some <br />locations were saturated from snowmelt and runoff. Other than the use of the shop and truck <br />wash facilities, there was no activity at the mine site. <br />Availability of Records <br />The pond certification report for the Truck Wash Ponds could not be located during the records <br />review. After further review of the PAP, it was determined that an As-Built Report and As-Built <br />Drawing were never submitted for the Truck Wash Ponds. A Design Drawing (Exhibit 7-16) <br />was certified on July 5, 1984. <br />Certified As-Built Reports were available for review for Pond 008, the PeCoCo Pond, and the <br />Spill Control Pond #2. As-Built Reports are contained in Appendix 7-6a, 7-6b, and 7-6c for <br />Ponds 002, 003, and 004, respectively. However, a qualified registered professional engineer has <br />not certified these reports. <br />All other required records were on file and available for review at the Seneca II Mine office. See <br />the attached records checklist at the end of this inspection report. <br />Roads <br />Access to the site was limited to the lower portion of the access road above the Wadge <br />Impoundment, the access road leading to the PeCoCo Pond, the two bone yards, and the <br />shop/facilities azea. All other mine site roads were impassable due to drifted snow and icy road <br />conditions. The access road above the Wadge Impoundment was only passable up to the <br />approximate location of Post Mine Channel 5. <br />Hydrologic Balance <br />Sedimentation Ponds 002, 003, the Ttuck Wash Ponds, and the PeCoCo Pond were inspected. <br />Ponds 002, 003, and the Pecoco Pond were full and dischazging cleaz water. The Truck Wash <br />holding pond was retaining water but was not discharging. The Truck Wash settling pond was <br />
