III. Comments - Compliance <br />Be]ow are particular issues with regard to any of the compliance items. <br />Enforcement actions resulting from failure to comply with the Act, Rules <br />and Regulations, and the permit also are identified below. <br />4.02 Signs and Markers <br />Mr. Wilson stated that periineterinarkers would soon be erected. The <br />corners of the permit area are presently marked. <br />4.05 Hydrologic Balance <br />1. The dewatering pipe of pond Z was plugged with sediment. The pipe <br />must be cleaned as soon as possib]e. <br />2. The operator must submit certification by a registered professional <br />engineer, that sediment ponds K and Z have been constructed as designed <br />and keep a copy of the certification at the mine site. <br />3. Sediment pond A must be constructed as soon as possible. A small <br />amount of disturbance in the drainage area has already occurred. <br />The drainage ditches that are designed to lead to sediment pond A were <br />discussed with Mr. Wilson. Because of the presence of numerous <br />foundations from the old town of Pryor, and undulating topoyraphy, it was <br />agreed that these ditches would be difficult to construct. It was <br />suggested to Mr. Wilson that t~vo additional ponds with short drainage <br />ditches be constructed. A technical revision would have to be submitted <br />for Division approval. <br />4.06 Topsoil <br />It was observed that very little undisturbed topsoil is present in the <br />location of the 1982 pit (the pit being actively mined). Numerous <br />foundations from the old town of Pryor are present in the pit area. In <br />addition, coal waste and clinker are spread over much of the surface. <br />I~r. Wilson was told that small amount of clinker or coal waste should not <br />preclude topsoil salvage but amounts that would noticeably color the <br />topsoil black should be avoided. <br />Topsoil stockpile markers should be erected as soon as possible. <br />4.14 Backfilling and Grading <br />The operator was actively backfilling the northwestern portion of the <br />1982 pit. <br />
