~9c~ oa ~ <br />that needs to be removed prior to the Division issuing a proposed decision on the <br />bond release. <br />Backfilling and Grading: -The regraded pond 3 area was surveyed for both area and <br />elevation during the inspection. The area of the disturbance, as it stood the day of <br />the inspection, was 2.47 acres. The surface area of the pond was 1.41 acres. The <br />Division believes that this additional disturbance is both acceptable and necessary <br />due to the need to regrade the pond with heavy equipment. The following chart <br />gives the elevations for the pre-mining and post-mining pond 3 area. <br />LOCATION PRE ELEV. POST ELEV. EFCI and the landowner(s) will <br />need to determine if the remaining mounds of dirt (with the trees) should remain or <br />be graded into the surface. This needs to be finalized and completed before a <br />proposed decision can be issued. <br />- The South Fan area has been regraded. This area appears to conform to the <br />natural topography in the area and meets the approved post-mining topography. <br />The Division believes that EFCI has met the requirements for this area. <br />- The explosives bunker area has been regraded. This area appears to conform to <br />the natural topography in the area and meets the approved post-mining <br />topography. The Division believes that EFCI has met the requirements for this area. <br />- The area along the east side of the facilities area (where there were coal fines that <br />have not been cleaned up) still needs to be cleaned. The fence was down and the <br />area was ready to have the work performed. This needs to be completed before a <br />proposed decision can be issued. <br />Processing Waste: -The refuse pile has been regraded and covered. Two slopes <br />were taken on the northeast corner. These slopes were 32.1 ~ and 30.1 %. Two slopes <br />were taken on the southwest corner. These slopes were 24.6% and 10.3% (the 10.3% <br />was on the final portion of the pile to be opened and it was not completely filled with <br />refuse). One slope was taken on the west side of the pile. This slope was 27.3. The <br />permit and Rules allow slopes up to 3:1. The slopes on the refuse pile are less than 3:1 <br />and are acceptable and comply with the permit. <br />- The area of the refuse pile was calculated to be approximately 37.3 acres (the 100- <br />year ditch was used as the toel of the pile so the actual footprint is less than 37.3 <br />acres). The permitted area for the refuse pile is 38.0 acres. The size of the refuse pile is <br />acceptable and complies with the permit. <br />-The borrow area was surveyed for area and volume. The size of the borrow area is <br />2.8 acres. The permitted size for the borrow area is 3.9 acres. The volume of material <br />taken from the borrow area was approximately 23,000 cubic yards. EFCI estimated <br />and was permitted to remove 45,800 cubic yards of material. The depth of <br />excavation was estimated (in the permit) to be 5.1 feet to meet the soil requirements <br />
