Compliance wits Colorado Surface Coal 'fining Reclamation Act <br />CRS 1973, as amended 34-3J-10'_, et. sea., <br />and the <br />Rues and Regulations issued Pursuant a ~Se Act <br />This includes a Zistiag of the particular provisions of tt;e regulator3 program which were <br />examined during the course of t'v:s inspection, and identifies enforcement actions taken <br />during the inspection for failure to comply with the Rules and Regula~ons, the Act and <br />the perm: t. ~ <br />4.02 Signs and Markers <br />Mine permit and identification signs and topsoil markers were in place and in <br />compliance. <br />4.03 Roads <br />All roads and associated ditches and culverts have been properly maintained. Even <br />with considerable rain during the Iast month, little flow has occurred through the <br />culverts. Some ponding was noticed near the flume in the western portion of the permit <br />area. The oradient of the ditch in this area should be checked in the~ext ctuarterlK <br />inspection. <br />4.04 Support Facilities <br />A small coal stockpile has been Located near the truck scales for use in regulating <br />the tonnage of off-site truck haulage. This area should be constructed to minimize the <br />contribution of additional suspended solids to runoff. The operator wi1Z be addressing <br />this issue in the permit application. <br />4.05 Hydrologic Balance <br />Although the sediment control system has been well-designed, a few possible problems <br />were noticed in the field. Riprap~applied to the side of the embankment at the emergency <br />spillway will have a tendency just to slide downhill when and if water goes over the <br />spillway. Possibly a modification of the gzadient would help. Secondly, the valves of the <br />spillway/dewatering device are located in the sediment storage area in Pond H. <br />4.06 Topsoil '~' <br />It appears that a small load of overburden material was mistakenly placed on <br />topsoil stockpile B. The stockpile must be more clearly identified to prevent such a <br />recurrence for topsoil is a very valuable commodity which should be protected. <br />TOpseil stockpile A is still active, therefore seeding at this time is not warranted. <br />The operator should investigate topsoil storage methods for an active pile to minimize <br />wind erosion. <br />4.28 Suonort Facilities Not Located At or Near the Mine Site <br />As noted in the previous report, unpermitted operations have occurred at the North- <br />gate Zoadout facility resulting in the issuance of three Notices of Violation. The <br />salvaged topsoil has been mulched and presumably was seeded, but the marshy area which <br />was disturbed has not been reclaimed. Furthermore, no plans have been submitted regarding <br />
