Compliance with Cotara do Sur'ace Coal Mining Reclamation Act <br />C~ZS 1973, as amended 34-33-101, et. sea „ <br />' and the <br />' Rules and Regula t ons Issued Pursuant to 'he act <br />~ This includes a Zistin of the <br />~ S partcu_'ar provis_ons of the :egulacory program which were <br />examined during the course of this inspection, and ident_F`es enforcement actions taken <br />during the inspection for failure to comply wieh the Rules and Regina tons, the Act and <br />i the permit. <br />I <br />4.02 Signs and Markers <br />All signs and markers are in good condition and in compliance. <br />4,03 Roads <br />AIZ roads were in good condition at the time of the inspection. Additional gravel <br />has been placed along the Access/Haul road. Total depth of gravel is approximately 14". <br />A11 culverts were clear and functional. <br />4.05 Hydrologic Balance <br />The emergency spillway on pond H is placed such that any discharge from it would <br />flow at the toe of the embankment. Rock riprap should be placed to protect the embankment. <br />The operator has initiated topsoil stripping in the phase II area prior to ca_nstruction of <br />sediment control ditches. It is reiterated that sediment control facilities~(including <br />diversions, ponds, and ditches) must be in place and functional prior to disturbing an <br />area. The cornet of ditch D needs to be dressed (deepened) so as to prevent any over- <br />topping of the bank. <br />4.06 Topsoil <br />Placement of overburden of topsoil stockpile B was not evident to this inspector <br />at this time. The topsoil pile which contains saline-sodic soil should be marked with <br />a sign. <br />4.15 Revegetation <br />Several ~Ee~as will need to be seeded and mulched this fall•if additional vegetative <br />growth does not appear. These include the embankment at Mann Draw, the outslope of <br />pond H, and all topsoil stockpiles. <br />9.18 Protection of Fish, Wildlife, and Related Environmental Values <br />Cattle were found inside the permit area, and gates were down. The operator stated <br />that calves would squeeze between the barbed wire and remain in the permit area with no <br />water.. To alleviate this, the gates were opened. No cattle have interfered with operations, <br />and the grazing season ends in early July for BLM allotments surrounding the permit area. <br />4.28 Support Facilities Not Located At or Near the Mine Site <br />The proposed Zoadout facility at Northgate was inspected, and remains much the same <br />as in the May, 1981 inspection. The depression which has been proposed as a sedimentation <br />pond contains tar approximately four feet deep. At the time of the inspection, a young <br />calf was. trapped in the tar. This area must be fenced or filled. <br />
