III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This was a complete inspection conducted by Joe Dudash. Bill Bear represented the operator during the field <br />inspection and records check. The entire mine site is in very good condition. <br />Main Mine Site <br />There was a large amount of coal stockpiled on the D-seam portal bench and on the coal stockpile bench at the <br />bottom of the hill. The berm on the coal stockpile bench kept coal from going onto the bench outslope and the <br />adjacent highway. There was no evidence of fugitive dust offsite or coal dust being tracked onto the main <br />highway. The cut and fill slopes of the various facilities benches were stable. The fill outslopes had a good stand <br />of vegetation on them. Each bench had a functional berm on the outside edge. The paved haul road and dirt <br />access and light use roads were in good condition. Road guard rail and road edge berms were in place. Surface <br />disturbance markers were up around the disturbed area. The mine ID sign was up at the entrance and at other <br />appropriate places and contained the correct information.. <br />The rock catchment berm above the utility bench has not moved and no rocks have threatened its stability. The <br />topsoil stockpile on the utility bench was vegetated and the topsoil sign was up. At the D-seam portal bench, no <br />leaks were found at the fuel barn. The B-seam portal bench facilities were well organized. The excess material <br />storage area next to the B-seam portal bench appeazed to be stable. The main topsoil stockpile had a good stand <br />of vegetative growth. The topsoil sign was up. Adjacent to the main topsoil stockpile, the material storage area <br />was in good shape. The same was true of the material storage areas on and to the east of the D-seam portal <br />bench. The wash plant area was clean and orderly. <br />Culverts and ditches at the mine all had sufficient capacity. There was a small amount of standing water in Pond <br />B. The pond embankment was stable. The float was attached to the primary discharge pipe. <br />Coal Refuse Stockpile Area <br />The gob pile haul road was dry and in very good condition. The outside berm of the haul road was in place and <br />the road ditch had sufficient capacity. The material storage areas were orderly. The haul road leading up to the <br />top of gob pile no. 1 was in fairly good condition. Small piles of development waste were on top of gob pile no. <br />1. The underdrain was exposed at the rear of gob pile no. l .The upland diversion ditch was functional. The <br />operator was excavating soil material from the new borrow area that lies between gob pile no. 1 and gob pile no. <br />2. Most of the soil material was being used to cover the refuse on the lower slopes of gob pile no. 2. There was <br />positive drainage on the top of gob pile no. 2. Both rock underdrains were exposed at the rear of gob pile no. 2. <br />The upland diversion ditch had sufficient capacity. The other ditches and culverts in the gob pile area were <br />functional. <br />The water levels in Pond C and Pond D were below the primazy discharge pipes. The spillways of both ponds <br />were operational. There was only a little standing water in Pond F. The float was on the primary discharge pump <br />hose. A few more surface disturbance mazkers would be helpful in the area around Pond F. The coverfill and <br />topsoil stockpiles in the gob pile azea were stable. Topsoil signs were present. There were no problems at the <br />pump house although more surface disturbance markers are needed. <br />
