<br />Ill. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made <br />during the inspection. Comments also describe any enforcement actions taken during the <br />inspection and the facts or evidence supporting the enforcement action. <br />supports a cover of shrubs and grasses which is rather sparse, <br />but comparable to adjacent undisturbed areas. Given the <br />erosional stability of the embankment, and the presence of <br />mature vegetation, additional vegetative stabilization efforts <br />would not appear to be warranted. The operator has contracted <br />with an engineering firm to conduct required stability <br />analyses. The work can apparently not be conducted until late <br />April, necessitating an extension for final abatement of NOV <br />C-97-001, which had originally been set at April 1, 1997. The <br />abatement deadline has been extended to April 23, 1997, which <br />is the 90th day following issuance of the NOV. <br />The operator has submitted a request for extension of the <br />abatement deadline beyond the 90th day, to allow for <br />completion of the stability analyses, submittal of adequacy <br />responses to the Division, and the to day public comment <br />period following DMG approval. The request has been forwarded <br />to the Division Director for authorization. <br />Pond 4 -- Dry. The operator indicated that an issue arose <br />during the CDPS permit renewal which is currently in progress <br />regarding the location of Pond 4 discharge. Although the pond <br />seldom holds water and has never discharged, if it were to <br />discharge, flow would potentially enter the adjacent <br />irrigation canal. Preliminary indications are that the ditch <br />company may not authorize discharge into the canal, and if so, <br />Powderhorn would need to submit a revision to construct a <br />ditch to convey discharge to the Coal Creek drainage, or <br />otherwise bypass the canal. <br />Pond 6 -- Dry. <br />Pond 10 -- Dry. <br />Pond 11 -- Dry. <br />Pond 1/2 -- Small puddles. <br />Pond 7 -- Dry. <br />Pond 9 -- Dry. <br />Pond 8 -- Water level appeared to be approximately 5 feet - <br />below the spillway elevation. There was a small inflow <br />(approximately 2-3gpm) entering the pond on March 31. Source <br />of the inflow was drainage from the Roadside South Portal, <br />which was entering the drop inlet drain on the portal bench <br />and draining into the pond. The water was draining from a <br />sump within the mine which had filled due to a pump which <br />malfunctioned over the weekend. Repairs to the pump were <br />being undertaken at the time of the inspection. <br />
