<br />III. COMMENTS -COMPLIANCE <br />Below are comments on the inspection. The comments include discussion of observations made during <br />the inspection. Comments also describe any enforcement actions taken during the inspection and the <br />facts or evidence supporting the enforcement action. <br />This partial inspection of the Chimney Rock Coal Mine was conducted by Wally Erickson <br />from the DMG Durango office, 484 Turner Drive, Building F, Suite 101, Durango, CO <br />81301, phone (970) 247-5193. No activities were observed, no mine personnel were <br />encountered during the time of this inspection. <br />Permit area is divided into three areas titled, Revision 1 Area, Barren Ridge Area, and <br />East Pit Area, as depicted on Map 8, Drainage Control, revised 3/20/95. East Pit Area is <br />separated from the other two areas by Stollsteimer Creek. Access from East Pit Area to <br />Barren Ridge and Revision 1 Areas is provided by low water crossing. Due to high <br />water in Stollsteimer Creek, only East Pit Area was inspected. <br />Mine identification sign and safety signs were posted at mine entrance. Public access is <br />controlled by locked gate. Mine access road was well maintained. Perimeter markers <br />and safety signs were posted along permit boundary. Topsoil sign was posted on <br />topsoil stockpile located at north end of East Pit Area. <br />Hydrologic Balance - Sediment Trap A, located in the SW corner of East Pit Area and <br />adjacent to mine entrance, was dry. Embankment was well vegetated and appeared <br />stable. Spillway structures were not evident. <br />Sediment containment ditch 1, conveying drainage to Sediment Trap A, was not <br />inspected. <br />Sediment Pond 002, located in the SW corner of East Pit Area, was dry. Pond inlet was <br />lined with rock and appeared stable, no evidence of excessive erosion. Pond <br />embankment was well vegetated and stable. Primary spillway was 18" CMP, inlet and <br />outlet of CMP were clear of sediment and debris. Evidence of excessive erosion was <br />not located at discharge point of primary spillway CMP. Secondary spillway was open <br />channel, riprap lined and stable. <br />Sediment containment ditches 5 and 6, conveying disturbed area drainage to Sediment <br />Pond 002, were well maintained. Ditches appeared stable, culverts were clear of <br />sediment and debris. <br />Three groundwater monitoring wells were located along the west side of East Pit Area. <br />Well casings were 4" PVC or 2" PVC pipe. Well casing and cap were intact and well <br />maintained. <br />South bank of Stollsteimer Creek, along location of low water crossing, was well <br />protected from erosion by large irregular sandstone riprap. Riprap appeared competent <br />and stable, no evidence of channel bank erosion located along ripraped section. Tracks <br />and droppings of elk and deer were abundant along Stollsteimer Creek. <br />
