This permanent berm must be revegetated to stabilize against erosion
and weed infestation. The operator has committed to providing DMG with fertilizer recommendations resulting from topsoil
sample analysis. Please, by the correction date noted on the next to last page of this report, submit these fertilizer
recommendations, perform revegetation tasks, including fertilization according to analysis recommendations and submit
photographic documentation of compliance with this corrective action,
The highwall on the north side of the Amendment No. 1 parcel appears to have encroached slightly closer to the
landowners north fence than the fifty foot buffer allows. Please, by the correction date noted on the last page of this
report, conduct final grading of the portions of this highwall that have encroached upon the 50 foot buffer, take measures
to ensure that no future encroachment occurs and submit photographic documentation of compliance with this corrective
action.
It appears that portions of the south and north pit slopes in the west pond are not at the approved final grade as indicated
in the Amendment No. 1 application file. The current reclamation cost estimate assumes that these slopes are at the
approved final grade. Please, by the correction date noted on the next to last page of this report, verify the grades of these
slopes and perform any regrading required to bring them into compliance and submit photographic documentation of
compliance with this corrective action.
The north, east and south sides of the west parcel are for the most part devoid of vegetation though these areas were to
be revegetated a few years ago and were not included in the current reclamation cost estimate. Please, by the correction
date shown on the next to last page of this report, complete the reclamation tasks on these areas as approved and submit
photographic documentation of compliance, or submit a revision application addressing incorporation of revised mining and
reclamation plans and reclamation costs for the mining operations currently taking place.
Responses to this inspection report should be directed to Steve Shuey at the Division's Durango Field Office.
