III. COMMENTS - COMPLLANCE <br />Below aze comments on the inspection. The comments include discussion of observations made during the <br />inspection. Comments also describe any enforcement actions taken during the inspection and the facts or <br />evidence supporting the enforcement action. <br />This was a complete inspection, conducted by Joe Dudash of the Colorado DMG. Basil <br />Bear represented the operator during the records check. There was snow on the ground at <br />the higher elevations. There was no activity at any of the mine site locales. <br />Well Field <br />Snow covered the entire site. The road, however, was passable. The mine ID sign was up <br />and contained the correct information. The topsoil stockpile sign was also up. <br />Run-of--Mine Pile <br />The mine ID sign was up at the entrance. Most of the ROM pile was covered in snow, but <br />the road was passable. The pond had a little snow in it, but no melt water. The gated <br />primary valve was closed. Most of the pond embankment was covered in snow. <br />West Mine <br />Most of the West Mine was snow covered, although baze earth is starting to show from <br />the melting of the snow cover. The road up to the West Mine was snow covered but <br />passable. The road up to the fan site was mazginal. The two sediment ponds were mostly <br />snow covered. <br />Hiehwav Coal Stocknile <br />There was no snow on the ground. The sediment pond had a little snowmelt in it. The <br />pond had sufficient capacity. The piping needed for pumping out the pond was in place. <br />Straw bales were in place along the south side of the railroad tracks and at the culvert <br />inlet on the west end of the site. The mine ID sign was on the ground at the site entrance <br />and needs to be put backup. There was no gullying observed on the site slopes. <br />Train Loadout <br />Two of the three gates were closed at the site. No trains were on site being loaded and no <br />coal haul trucks were being unloaded during the inspection. There were no problems with <br />fugitive dust. The pond was dry. The pond bin wall was stable and the gated primary <br />discharge valve was closed. All of the collection and diversion ditches and culverts were <br />functional. The operator has placed straw bales azound the clean water diversion culverts <br />on the south side of the tracks. The straw bales at the top of the orchard road, next to the <br />
